looked upon in this age of enlighten-
ment, and especially in the domain of
Uncle Sam, as almost a God given
right. It is engraved In our constitu-
tion. It is laid down as one of the
great bulwarks of a free thinking and
law-abiding people. The article
written, of which McMaster was the
I author, did not really cast per see any
insinuation on Judge Scott or hi<

then are our boasted liberties a myth.

press guaranteed by the constitution

he has mistaken the dignity of courts.

The action of Judge Scott, of Okla-
homa City, in sentencing old man Mc-
M.istcr to oix months in Jail aud fin-
ing him $500 for contempt of court is
very much to be regretted, mainly for
the reason that circumstances should
exist making such a move seemingly
necessary. It is hard to either con-
demn or condone one without the
other coming in for an equal share.
Both are to be blamed. While it is
t le duty of a judge to sustaiu the dig-
nity of his court it is equally incum-
bent upon an editor to sustain the
freedom of the press. While the sen-
tence of the court wie cruel and se-
vere, the provocation may have been
such as to warrant it, yet we have
our doubts about it. While editors
are 'sometimes injudicious and vin-
dictive, Judges should never allow
themselves to be. We believe that
a great deal of Judge Scott's troubles

been extremely rasping and untrue,
but they are disappointed that a
Judge, as appears in this case, would
tly into a rage and use the machinery
of his court for self-protectiou from
criticism which, wheu unjust and un-
true, only revolted upon the editor
aud raised the judge in the esteem of
his friends.
The public cannot see any region
except personal rage for the Imposi-
tion of a six months jail sentence and
1500 Hue on a man G5 years old and
whose editorials, had they gone un-
noticed by the judge, would not have
produced a ripple on the Judicial sea.
The ncwtpupeis in and out of the
territory look upon Judge Scott's ac-
tions as a blow at the liberty of the
press, without which the public has
no protection from misdoers, public
or private; without which every court
may become a despot.
There is a great principle In ti is
matter: to allow Scott's action to ^ o
unrebuked and unretrleved means a
setback to the rights of men, a dis-
grace to American pTbgrots aud a
m'nance to the very Institutions
which have made America what it is
today.'
Tho press, irrespective of party, is
taking this matter up and, unlesa
Judge Scott wipes out at once his
grievous mistake, the deluge of public
opinion will sweep hiu from place
lunatic and should be sent ta the
