Judges in any of these cuacs. They
were far-reaching in their effect. In
the sooner decision Judge Clark wi-s
sustained by Judge Burford and
Judge (Ireeu wrote an elaborate dis-
senting opinion. The supreme court
of tho United States sustained the
territorial court. in the town lot
•ase Judge Clark dissented from the
decision of tho territorial supreme
court. The supreme court reversed
the territorial court and used Judge
Clark's dissenting opinion. Judge
Clark decided that the courts have a
right to inquir* into the respective
rights of occupants of laud while the
question of title is still pending in
the land courts, and ordered Sprout
removed from the land. A good
many made sport of the decision,
but the supreme court of the territo-
ry has sustained him, which gives
t'ie decision soma standing at least.
Judge Clark was slow because h«
was extremely careful. He never
guessed at even the most trivial
question. As a result he laid most
excellent foundation, and established

appointed to consult with Governor
