FAILED TO APPEAR.
Jess Allen, a negro, was before
Judge Clements this afternoon on a
charge of assault and battery and at-
tempt to kill, filed by his wife. Mrs.
Allen failed to appear as the prose-
cuting witness and the case was dis-
missed. Mrs. Allen charged that her
husband threatened to shoot her with
a Winchester rifle and had him ar-
rested. Mrs. Allen is a daughter of
J. H. Simmons, a prominent col-
ored man, and the case was probably
settled out of court.
