That Secretary IJ-n W. Riley of the
Htate election board does not under
the last law on the subject have to
be confirmed by the eenate in other
w( rdn that the governor's appoint
merit absolutely settles the matter
without any action by the senate
whatever Is said by several member;
of the senate iwho have 'been looking
up the statutes to be a fact.
Connerijcntly the long investiga
tion aiu probe by the senatorial com-
mittee and the action of the senate
in rejecting Secretary Riley is with-
out any force and effect of law what
ever and that he holds on as secre
tary of the state election board Juut
a If the senate had never probed the
affairs of that office. Those who con
tend that this is so base their argu
men tupon the alleged fad that the
IS 11 legislature repealed the at of
a former legislature to require the
apikiiutnent f the secretary and
member of the state election board
to bo confirmed by the senate and
that under the Inst net the members
and secretary of the election board
serve by the appointment of the gov-
ernor only until February 1 1913
but that without confirmation of the
senate. Oklahoman.
