Washington Nov. 5. Revolution-
ary changes in procedure in equity
cases in feJerai courts throughout
tho United Stales are effected in re-
vised rules promulgated today by
the Biipreine court of the United
States. The object Is to reduce the
cost of litigation t-iul to eliminate
delays.
Among the now rules of procedure
announced by the supreme court to-
day is one which vould prohibit is
sues of preliminary restrictions with
out notice to the opixmlte party and
also restricting Issues of temporary
restraining orders.
For seventeen months Chief .lus-
tice White and Justice Luiton and
Justice Van Uevanter have been
working on the equity rules as a
sub-ccmniittee of the court They
asked every federal judge throughout
the country to jet expressions from
bar associations and wrote to many
others asking for suggestions. These
suggestions were digested by th-.'
sub-committee. The present rules
enme down from the courts of Eng-
land with only ono or two revisions
since the beginning of the republic.
Chief Justice White explaining
some of the new rules groupod the
reforms under fcur or five heads.
Ono was Id regard to the exercise
of power by tho 'federal courts in
equitable matter.
Another was described as being de-
signed primarily to remove all un-
necessary steps in modes of plead-
ing and to bring tho parties qufckly
to tho Issue.
Another was described ns being
a restriction in iho modes of taking
testimony pnrticulaily in patent and
copyright cases.
'The whole intention has been"
said the 'chief Jtstice "to bring the
taking of testimony down to a more
simplified and inexpensive method."
The chief Justice would make It
possible for ths appellate court not
to reverse suits merly because of
errors not prejudicial The rules will
co into effect Februnry 1 1913.
