INDIAN MEASURE

Washington, May 20.—Senator
Owen today reported from the sen-
ate committee on Indian affairs his
bill providing for a review by the
district court of Oklahoma of about
thirty claimants to citizenship in the
Osage Nation. The Osages are op-
posing the bill and it is doubtful
whether the measure can be passed
under the circumstances. The Auld
family of claimants is added to those
who would have their rights deter-
mined upon in this way.

Mrs. Frank W. Rollins, wife of
the former governor of New Hamp-
shire who with her husband and son
is now under arrest in New York
on the charge of smuggling. Mrs.
Rollins wasprostrated by the arrest
and has been under the constant
care of a physician since. She has

Macon, Mo., May 20.—The Macon
Circuit court says that a person who
ventures too near the protesting
hoofs of a Missouri mule, when the
animal Is clearly In an ill humor Is
guilty of contributory negligence.
Broad Johnson, a driver employed
In a mine here, was driving the mule
"Jessie James" along the mine en-
try on Nov. 6, 1908, when the air
underground became so foul as to
disturb the mule's placid tempera-
ment.
"Jessie James" bombarded Johr-
aon with kicks until the man be-
came unconscious. Johnson sued
for $10,000 and the company made
the 'lalm that It had settled for $32«
In the argument on the demurrer,
the defense offered a searching ana-
lysis of "Jessie Jsmes," which tend-
ed to show that the mule bore an
unblemished reputation barring this
Incident.
Tbe demurrer was sustained on
the ground that Johnson had stray-
ed too near tbe flrlng line.

Wheeling, W. Va., May 20.—Lou's
and Temple Abernathy arrived at
Wheeling Tuesday evening both in
good condition with the exception
of a slight cold contracted by the
younger boy. They covered sixty

Ohio, in the morning. They made
one stop, for dinner.
The boys were royally received by
the proprietor of the Hotel McLure
Mayor Schmidt and other prominent
