suance to a resolution adopted by the
Mayor and City Councliinen of the
City of Enid, Oklahoma, on the 17th
day of December. 1909. sealed propos-

the City Council Chamber of said City
until 10 o'clock a. m.. January 17th.
1910. for furnishing the materials and
doing and performing the work neces-
sary for grading, curbing. Kutterlng
and pavInK with vitrified brick upon
a five inch (5 In) Portland cement base,
and by draining, including the Installa-
tion of the necessary manholes, catch
basins and drainage tile. In accordance
with the plans, profiles, exhibits and
specifications now on file In the office

The Legislative Body or said City of
Enid shall not be deemed by the gran-
tee of the privileges contained In this
the ordinance, to have waived or aban
doncd ihe right to make any and all
needful and reasonable police regula-
tions with reference to the operation
and maintenance of such street car sys
tem; at all times, have the power to
pass ordinances regarding the use of
head lights, gongs, fenders, and
other needful rules and regulations for
the protection of the Inhabitants of
said City, and passengers in connec-
tion with the operation of said railway,
provided the adoption of said motive
power will not cause an Increase In
the amount fixed herein to be-oharged
for the transportation of passengers.
The cars of said railway shall, at all
times, be entitled to the track and driv-
ers of vehicles on the streets or on
the sides thereof, shall turn all ve-
hicles out on the approach of street
cars, so as to have the track unob-
structed for the passage of such cars;
provided, that steam fire engines or
other apparatus of the City of Enid,
shall, at all times, when answering the
alarm of fire, have the right of way
where possible, over across and along
the tracks of said street railway; and
the cars of said grantee shall be stop
ped after the sounding of the fire
alarm, and upon the approach of fire
engines, hose carts, or other fire
paratus. which stoppage shall be made
when such apparatus is within a dis-
tance of 300 feet of such cars, and such
cars shall remain standing until the
same have passed
All cars shall be equipped with gongs
to be used for warning upon the ap-
proach to street crossings, and shall
be provided with head lights when run
after night. They shall be operated
on an average speed of not more than
per hour in the business por-

The main business offices of said

The rights granted In this ordinance
shall be subject to the right of the city
to grant similar rights to others, on
any other street or streets than those
occupied by the grantee herein, with its
track or tracks.
Section 12.
That in case the said grantee, his
