ORDINANCE NO. 277.
An Ordinance levying and assessing
a special tax against each lot or
piece of ground in Sanitary Sewer
District No. 2, in Pemberton
Heights Addition to the City of
Bartelsville, Oklahoma
Be it ordained by the Mayor and
Councilmen of the City of Bartles-
ville, Oklahoma:
Section 1. Whereas, a majority
of the property holders within that
district in the city of Bartlesville,
Oklahoma, described as Pemberton
Heights Addition, in the city of Bar-
tlesville, Oklahoma, have petitioned
for the construction of a district
sewer in the alley between Cherokee
avenue and Osage avenue from Elev-
enth street to Thirteenth street, and
in the alley between Delaware ave-
nue, Cherokee avenue from Eleventh
street to Thirteenth street, and con-
necting with the sewers at Eleventh
street.
Whereas, the prayer of said peti-
tioners has been heretofore granted,
and the said' sewer constructed, as
prayed and as required by law; and,
Whereas, the total cost of said
sewer, together with the cost of en-
gineering and inspection amounts to
$3,723.42; end
Whereas, the city engineer having
charge of said work has computed
the whole cost thereof, including all
other expenses incurred by the city
exclusive of the contract price of said
work, and has apportioned the game
against all lots or pieces of ground
in said district, exclusive of the im- ;
provements in proportion to the area '
of the whole district, exclusive of I
public highways, and bis reported j
the same to the Mayor and Council-
assessment, then the mayor and
councilmen will c^nse tax warrants
to be issued against such lota or
pieces of ground, reciting the date
of the passage of this ordinance, the
amount of the assessment, the de-
scription of the property against
which the same is levied and that
the same will be levie^ against said
property in three equal installments,
with interest thereon at the rate of
eight per cent per annum, levied
each year, to become due on the 15th
day of December next after each
such levy to pay the maturing in-
stallment*, and said tax warrants
shall be signed by the mayor and
countersigned by the city clerk, and
shall be delivered to the contractor
in payment for the construction of
saij sewers.
Section 4. An emergency is here-
by declared by reason whereof it is
necessary for the preservation of the
public peace, health and safety that
this ordinance shall become effeotivs
from and after its passage, approval
and publication.

McAlester, Okla., August 4.—
Judge Higgins of the county court,
after listening to evidence for ten
days in the will case, today admit-
ted the will to probate, finding that
Joseph R. Barnefct. at the time of the
execution of the same was both sober
and sane and of disposing mind.
The will leaves $80,000 to build
two Southern Methodist churches and
parsonages in McAlester; an allot-
ment worth $.">,000 to Dave Hopkins,
who handled his affairs for fifteen
y««irs, and $a,000 to Colonel James
•T. McAlester, corporation commis-
sioner of Oklahoma, for services as
executor.
The relatives are cut off with $1
each, except a sister, who is given
$5. The ca.se wiU likely be appealed
to the supreme court.
