Oklahoma City, Julie 30.—An opin-
ion in the race track gambling mat-
ter was received Thursday by Gov.
Lee Cruce from c. L. Moore of At-
torney General West's office, but de-
tails of the natura of the opinion
positively refused Thursday
night by Oov. Cruce, other than that
gambling on the races Is held to be
nuisance per Be" and should be
abated. "The opinion belongs to the
attorney general's office and you will
have to get It from Were," declared
Gov. Cruce. A request for :ho opin-
ion was made several day,, ago, when
tho matter was brought to the atten-
tion of the governor by a statement
of F. b. Ufer, manager of Carl Mor-
ris, in which Ufer declared that it
might be better to stop raco track
gambling In Oklahoma City than a,
prize fight at TulBa. "What stops
will you take In the matter Blnce the
opinion has been received?" Gov.
Cruce was asked Thursday night. I
have not gone Into it thoroughly
enough to determine as yet," he re-
plied. "but if bookmaking at the track
is a nunisance and can be abated, it
will be." It is understood that in
his opinion Mr. Moore cited a num-
ber of opinions of supreme courts In
which It is hold that gambling at
race tracks 1b a nuisance.

who figured not only In the smug-
gling scandal, but in the Hotel Lor-
raine robbery in which Mrs. Jenklusj
lost $300,000 worth of jewels, t el-
le, tor Loeb refused to discuss the re-
nort that one of his inspectors had
made a confession, nor would anyone
els, connected with the colectors-

standing the decision of District
Judge Huston, wherony W. H. Mit-
chell was ousted as chief of police

it will end. Attorneys for Mitchell,

McAlester, Okla., June 30—John
Martin, a convict from Seminole
county, with 18 months of a two
years' sentence to serve, escaped
from the Btate penitentiary Wednes-
day night. He had the mumps and
had been placed in an isolated cell
with a padlock. He picked the lock
and got into the rotunda and from
there to the top of the administra-
tion building. He cut the rope from
the flag-pole and with this lowered
himself to the grounds outside the
wallB. Two negro convicts, while
working on the brush gang, sought
to escape by running. The guards
fired on them and one, Lon Green,
from McIntosh county, was shot
through the leg. Both were caught.

Ralph K. Campbell, In an opinion
filed Thursday, holds that lands in-
herited by fullblood Indians from de-
coased allottees can be transferred
without the approval ot the secretary

opinion to that of Attorney General
Wlckersham, who gave an opinion
that in cases where the ancestor had
died before May 27, 1908, the ap-
proval of the secretary of the in-
terior was necessary.
