An alleged dying declaration
made by Hubert Colbert uti Indian
accusing Pete B. Cooper of Broken

of Cooper yesterday on the technical
charge of assault with Intent to kill.
The charge will l- "hanged to murder
should Colbert die. Cooper cme In

Colbert was found lying in the mid-
die of the principal street of Broken
Arrow at 7 o'clock Sunday morning

through his body. He had evidently
nun in the road for several hours. A
report from his bedside yesterday that
be had only a talni chance for recov-
ery led lo his making a dying deela-
ration in which he aci used Cooper of
doing the shooting. He Is said to have
told that he and Cooper "ere walk-
ing across the street about 8: so
o'clock Sunday morning when sud-
denly Cooper wit bout any warning
pulled u gun and shut him and then
lefi him In the road.
The shooting Is said to be B sequel
to a case tried in Justice of the
Peace 81a1 k'a court last Wednesday
when Cooper and .Mrs. t'uoper both
Indians Were held for the action of
the District Court on a charge of
adultery.
Since the trial however Cooper
