that city giving the facts us follows:
"While the north bound passenger
train was standing at tho depot this
morning, a number of bystanders say ;

ed another victim .

came to the rescue, but he at once pro-
nounced the stranger dead, and gave the
cause as heart failure.

In answer to his being in this cny on
the Thursday evening that the attach-
ment was issued for him and prior to his
departure for Chicago. Mr. Iilckam stilt-
ed that no service had hem made >i him
for his appearance before the grand Jury
and he did not think It necessary for
him to ascertain personally if he was
wanted by that body.
Judge Burford stated that County A'
forney McQulre had informed him that

inc. if necessary, to come to Guthrie to
testify that Senator Iilckam did con-
verse' with County Attorney McGuIre on
last Thursdav afternoon, at the time that

if he had anything more to state on that
subject, Mr. Hickam answered that "if
the records of the office show that h
talked with McQulre at that time, that
he must have talked." It is held that
this was directly opposed to the state
ment of the previous afternoon whin In

cine. All members of the board shall be
pr- sent and participate In such examina-
tion. It shall be the duty of the regis-
ter of deeds. In a book k> pt for that pur-
pose, in the county in which
son resides or Intends to practice. Provid-
ed, that an osteopath shall not be> re-
quired to pass .in examination In materia
medlca or theraputics.
Any person practicing, or offering to
practice medicine or surgery In any of
their branches, without first having ob-
tained a license from this board, shall
be deemed guilty of a misdemeanor and
upon conviction therefor shall be fined
in any sum not less than fifty dollars
nor more than one hundred dollars, or by
imprisonment In the county Jail for
a period of not less than thirty days
nor more than six months, or by both
such fine and Imprisonment at the dis-
cretion of tho court, and all costs incur-

The provisions of this act shall not
effect the rights of persons now legally
practicing medicine, osteopathy, or sur-
ge v. in this territory; nor shall It pro-
hibit th- application of domestic rcm-e
dies by one member of a family to another
in case of emergency, without compen-
sation: nor shall It apply to any com-
missioned medical officer of the united
States army. navy, or marine hospital
service, in the discharge of his official
duties: nor to any legally qualified dentist
when engaged exclusively in the practice
of dentistry; nor to any physician or
surgeon from another state or territory
who Is a legal practitioner In which he
resides; when in actual consultation with
a legal practitioner of this territory;
nor to anv physician or surgeon resid-
ing on the border of a neighboring state
or territory and duly authorized under
the lavrg thereof to practice medicine or
surg rv therein, whose practice extends
into the limits of tills territory. Provided,
that such practitioner shall not open
office or appoint a place to meet patients
or receive calls within the limits of this
territory, nor to any osteopath who shall
pass examination in the subject of ana-
toifly. physiology, obstretrics and physi
cal diagnosis in the same manner as re-
quired of other applicant* before the
territorial board of health, and who
has thereupon received a certificate from
the board which, when filed with the reg-
ister -f deeds, as Is required In the case
of other certificates from the board the
Territory of oklahoma, but shall not
permit him to administer drugs, nor
perform ajor surgery.
The county boards of health shall eon-
slst of three persons; a legally qualified
physician appointed by the territorial su-
pefint. nilent. who shalj be superintendent
and secretary of the county board of
health, the chairman of the board of
countv commissioners who shall bo presi-
dent and a legally qualified physician ap-
pointed bv tie board of county commls
sloners who shall be vice president. The
superintendent of county boards of health
shall have power to abolish nuisances
that are dangerous to the public health
tf> isolate persons afflicted with danger-
ous or contagious .diseases, and to dr.
such other things with the approval of
the board as may be deemed necessary
for the preservation of the public health.
Such superintendent shall be paid for ex-
penses actuallv and necessarily contracted
In the discharge of his duties, together
with fees for duty performed Provided,
that the sum total of sue hexpenses and
tees shall not exceed one hundred dol-
lars p"r annum. Such bills of expens-
