! buildings and nine miles of side tracks

! hunt the State Capital has located the
1 cling on which tho business is hung up.
The corps of surveyors was sent to this
city and the local yards wi re staked off.
A Steam shovel was ordered and Contract-
or A. Moon came on with a big force
of m> n and teams to vtart to work. The
later have been on duty ever since,
whllo for the terminal buildings proper
there has been little accomplished.
After the stiikes had been driven and
work begun, it was ascertained that the
Santa Fe has been i templatlng a two
foot raise of the Kiad.i through the City
and in fact has fully determined upon it.
This was the snag that stopped the work
until the entire matter could be arranged.
In speaking with the Slate Capital man
yesterday an official said: "I expect the
work on the construction to begin this
week; that there has been a delay is no

THE DECISION.
Tho following Is the syllabus, prepared
by Judge lturwell, which contains prac-
tically tlie entire opinion:
"Territorial funds received by the ter-
ritorial treasurer remain tie m neyi f
the territory until the tn-i.-urer and every
other per- .n charged with the receipt of
safe k< eping or disbursement of such
funds is prohibited from loaning them
either for his own private us or for tie*
u.so of the territory, and from in any way
appropriating them to his ov\n private
use. Tho territorial moneys must be
preserved by tho treasurer anil r main
under his control at all times, so that
they may be forthcoming at any time
to meet the obligations of the territory,
but the treasurer, although not required
so to do. may deposit territorial funds
in a bunk In his official capacity and
ai cept Interest from such bank for daily
balance, provided the moneys r< main
absolutely under his cotrol and sub-
ject to payment on his demand, but th ■
interest received on such deposits, b lng
earned by the funds of the territory, be-
comes territorial mon ys in the treasur-
er's hands, for which he must account,
and he has no right whatever to appro-
priate such Interest or any part thereof
to his own use or benefit."

"I do not know that there is any thing

Tho case from the standpoint of the ter-
ritory has been successfully determined.
Whether thore will be further action by
tho treasurer of course I do not know.
The entire affair was merely the deciding
of an im>o tant question."

The idea is now being considered by
the Santa Fe to double track Its line
over the Oklahoma d'lvsion. Tho business
has increased so much in the past few
months that such a move they have decid-
ed will be very beneficial.
WANTED TO BE CITED.
The City Engineer Frazier instructed
by the city council, has had a confer-
ence with Resident Engineer A. W. Phil-
lips, of the Santa Fe In regard to the
grade to bo established by tho company
on its right of way at the foot of Har-
rison and Oklahoma avenues. The city is
figuring on establishing a grad.> f r tho
streets, curblngs ar.d walks, and desired
to know what chance, if any, the Santa
Fe will make. Tho Santa Fe, It Is under-
stood, has answered that no change in
the grade ut these two streets U con-
templated and that the city can safely
go ahead with any improvements desired.
FOR HOME SEEKERS.
The Santa Fe passenger department
anounces its intention of putting home
visitors' excursion rates In effect, and
for this occasion will make a on© fare
plus $2 rat© for the round trip, for all
points in eastern committee territory#
the eastern committe,. territory is tho
territory east of tho Missouri river,
west of Chicago and w< st of St. Louis.
This includes the states of Wisconsin,
Minnesota. Iowa, Missouri and porti-.s of
Illinois. Tickets 'on the homo visitars'
excursions will be placed on sale Septem-
ber 10 an l 20, and will be good for a
final n turn limit up to October 31. These
excursions aro to bo run especially to
enable Oklahoma and Kansas people
who come from the eastern territory to
revisit their former homes.
HEAVY STOCK BUSINESS.
The Santa Fe is beginning to call In
every available stock car in its sendee,
for the live stock agents of the company
have notified the operating department
that tho movement of cattle out of th
Panhandle country of Texas Ihto Kansas
and Nebraska this fall will be the heav-
iest in the history of tho road1.
Tills means that for weeks monster
trains of stock will come up over tho
Panhandle line of tho Sahta Fe and be
distributed along the lines at tho fold-
ing grounds I:. Kansas or «ent over tho
Superior branch to feeding stations in
Nebraska. The operating department la
consequently now preparing for the

good shapo by tho mid;® of next
month.
The live stock agents of tho various
roads are now busy making contracts
