tetute Capital For Libel But tlic
\aiue* Mtriitionctl Here
.\ever In Tliin Paper.
Tho State Capital has a way of going
after questionable things generally. Ha
clarifying articles often give tho public
large benellts, utid yet no one In pur-
| ticular is named. Lust winter wo began
a cru.sado on what we termed 1 't%~
muim Fakes." We used n> names. NN "
did not say who was running these
fakes; we gave neither individual, corpor-
ate or other name of any particular 'fake
if it has any name; we just battered
away on fakew in ge neral and espee.al-
iy the fakes known as "premium fakes."
We soon had the desired effect. Lika it
preacher gong after tho devil; he doe
not particularise. He gives sin of all
kinds and classes the particular tits it
deserves. He does not know anybody .s
personally hit, until some fellow arises
in the audience and pleads guilty. W*
went after this fake In such a general
way that we had no Idea anyone wouru
come forward and plead guilty. We were
talking only of fakes—and the man who
was not a take and running no fake w;is
not meant and should have no complaint
Ayet here com. s a fellow named Humes
Any yet here com- s a fellow—named
Humes—J. C. Humes, we believe, who
says we were hitting at him when we
went after what are known as the
"stamp fakes." Well, we ..ever heard of
him until we rend his plea of guilty.
This plea wa-s tiled In the district court
Tuesday by Dale & lilerer. it contains tiO
type-written pages; showing the confes-
sion to be of the most contrite sort; and
there are eleven counts—pleads guilty to
being ti fake e.even times He tusks a
thousand dollars damage for each count-
on eifh of ids confessions that the he is A
fake. As was once said by a prisoner to
a famous judge in this territory; "We
have that amount In our back poeket"
and will disgorge it If the fellow who
says In his petition he is the fake we
meant, will lind his name or the name of
the "eo-o|H rative" outtit he claims to rep.
resent. In any article we wrote on this
"stamp fake" quest on. Now. if he wants
to get off easy; get some money for noth-
ing. this Is a chance. Dale Ar Bierer hav**
persuaded him to acknowledge that he
and hi- outfit are fakes—and the fak> s
we are hitting a?, in order t-o get a suit
in court. It is plain 'that since we only
talked of fakes, this Hume outfit must
tirst plead guilty to this sort of ;i cljargu
I)' fore they . an say we m. an't them This
they proceed tu do—under the tutolage of
Dale At Bierer. But they will have a
lino time showing that we ever said a
word about them—unluss 'they vo.untart- j
ly take the matter to themselves; and !n j
that case it is purely a mater of con-
science with which the court has nothing
to do. The courts will n-ot take cogni-
zance of such pleas of guilty from men
against Whom nothing has been said. This
paper has no knowledge "t" ever hav«
ing said a word about this man or tli<*
particular business in th's town he
says he represents. We never 'heard of
him until we read the petition in which
he says he Is a fake. Our entire fusil-
ade w; i s against fakes—"stamp fakes;"
and If he is ligitimate, then we did not
mean him. If he was really fake, he is
Indelicate to allow a couple of hungry
lawyers to pull him into court wi'th an
acknowledgement 'that he is one; that
he comes in the category we are after.
He said we greatly Injured his busi-
ness. Well, ..ne fake here printed in a
paper that if we m- ant them our "articles
fell Iiko water on a ducks back, only In-
crease our business " But probably it
was not this fellow who says Iv comes
in the line of fakes we are talking aboui
He would not say one mouth we had
had no effect on his business, and the
next declare w. were right and ask a
thousand a wound for hie-- feelings that
appear to have been anonymous.y hurt
Mr. Hume Is a stranger to us. H:<
name has never been in this paper; ai d
neither has the outfit he says he has
been running. How could you anonym <usly
give basis for per >nal libel? Might as
well say that the man who talks about
the sin of gambling; or of swearing: <>r
of smoking; or of highway robbery; or of
common theft, gives cause for libel to
/f,ry man who is a. mind to Jump up
and acknowledge that he has done some-
thing to bring him in 'the lines we are hit-
ting at and thereby hurt his busln< -s
standing among good people. Verily, we
would think individuals that took such
things so personnally protested too much,
red pleas that were not called for
pt by guilty conscience.
is it come to pass that a paper can-
not berate commercial, moral and politl-
al eviles. using r > names, without hav-
ing some self-confessed fakir ask dam-
ages? Who would have thought Hume
was hit if he had nr/t taken >o pages
of lawyer's linen paper -o acknowledge
that he thought we murft have meant
him?
We have satd noting about Mr. Hume
or his bus n-s . We do not know them—
and from what he savs in his nlea .f
guilty, no one wants to know them Wo
have been af er fakes—and shall continue,
after them. The fellows who do not like
It. and declare the shoe pinches them. ,
wil. find it necessary • . get their sat i
faction somewhere elsn than in the courts. '
The courts were not built to satisf>
those who take every anonymous article
welting commercial and other outrages
as pers >nal to them.
