(1) . That the provision that if the
notes were not paid at maturity the
whole amount should be considered
earned is a mere penalty which can-
not be enforced.
(2) That the provision that if the
notes were not paid at maturity the
policy should be null and void is *
valid provision, but the company may
waive it.
(3) That the company, by retain-
ing the notes and endeavoring to col-
lect them in full, waived the provision
that the policy should be void if the
notes were not paid at maturity.

SYLLABUS.
No. 2285.
1. The mere purchase of the equity
of redemption in mortgaged land, does
not make such purchaser liable per-
sonally for the payment of the mort-
gage debt.
2. No personal obligation rests up-
on the purchaser of mortgaged land'
to pay the mortgaged debt, unless by
agreement he assumes its payment,
or, by retaining the amount out of the
purchase price, or otherwise, he clear
ly makes the debt his own.
3. Where the purchaser of mort-
gaged land has not assumed the pay-
ment of the mortgage debt, nor other
wise clearly made the debt his own,
a personal or deficiency judgment
cannot ordinarily, be rendered against
him in a suit on the debt, or to fore-
close the mortgage.
