to many of our citizens, and is also

Sheritf Lake, of Pawnee county, ar-
rived in the city today from Missouri
having in charge one John Griffin,
charged with grand larceny, lie
lodged his man in jail here for safe
keep ng till be can bo transferred to
Pawnee to be tried before the courts
of that county.

tract, and disclaiming any right to
this land in dispute occupies the same
position in this cause as an en try mar,
and has therefore a prima facia title
to the land, which can only be over-
come by a preponderance of evidence
as in case of_an actual entryman
contested by adverse claimant.
Sackett's application to enter, tiled
with his affidavit of contest, puts
him in no better position than that
occupied by either of the contestants.
From tho evidence given it was
showji that Wallace having been cal-
led away on account of sickness, and
thereby failing to secure a filing is
nevertheless entitled to the land for
the reason that he made the proper
settlement to the best of his ability
under tho circumstances. Therefore
Howe, McMeachen & Guthrey, coun-
sel for Wallace scores another victo-
ry by winning for their client this
tract of laud.
