RESOLUTION
A rerolution of the Mayor and
City Council of the City of Yale,
Payne County, State of Oklaho-
ma, determining to proceed fur-
ther with the improvement of
Stret Improvement District No.
5 of said City, said district be-
ing composed of Fourth street
beginning at the east line of“h
afreet and running east to the
west line of ‘F street; the west
alley running north and south
through Blocks 13 and 16 of the
said City and Main street, be-
ginning a t the south line of
Eighth street running south to
the north line of Ninth street.
W,HEREAS: ,On the 15th day
of March, 1920, the Mayor and
city council of the City of \ ale,
Oklahoma, adopted a resolution
declaring it necessary to improve
the following named parts of
streets and allies by grading, pav-
ing, curbing, guttering, draining
and otherwise improving same
sad improvements to compose
Stret Improvement District No. 5
of said city and said paving to be
of good paving brick lain on a
concrete Sbase 5 inches in thick-
ness in a mixture 1 inch in thick-
ness composed of three parts of
sand and one part cement, towit:
Fourth Street—Beginning at
the east line of ‘E’ street and run-
ning east to the west line of ‘F’
street;
Main Street—Beginning' at the
south line of Eighth street and
running south to the north line of
Ninth street;
And the West alley running
north and south through Blocks
Thirteen (13) ad Sixteen (16) of
said City.
AND WHEREAS, said resolu-
tion repuired the City Engineer to
make complete and acurate plans
specifications and estimate of the
cost of sad proposed imprvoe
ments, and
WHEREAS, said City Engineer
has made said plans, specifica-
tions and estimate and filed the
same with the City Clerk of said
City, and the Mayor and the city
council of said city at a regular
meeting held on said 15th day of
Murch, 1920, examined, consider-
ed and approved said plans, spec-
ifications and estimate and desig-
nated said proposed improve-
ments as Street Improvement Dis-
trict No. 5 of said City.
THEREFORE BE IT RESOLV-
ED by the Mayor ad City Council
of the City of Yale, Oklahoma
Section 1—That the City of
Yale, Oklahoma, proceed with the
improvement of said streets and
alley above named by grading,
paving, curbing, guttering,drain-
ing and otherwise improving the
same in acordance with the plas,
specifications and estimte of cost
heretofore prepared by the City
Enginer and approved by the City
Council.
Section 2—That the roadway
in that part of said Stret Improve-
met District No. 5 beginning on
Fourth street at the east line of
“E” street and running east to the
west line of "F" street be Thirty-
three (33) feet in width; that the
roadway on Main street begin-
ning at the south line of Eighth
street ad running south to the
north line of Ninth street be Sev-
ety-two (72) feet in width and
that the roadway of said alley be
the full width of the alley, towit

asked the merchants of Yale to close
their places of business at 6:00 P.
each week day except Saturday and stay
closed all day Sunday.

two grocery stores and one

curb shall be of concrete Six (6)
inches by Eighteen (18) .inches.
Section 4—The contract for the
improvement of the above named
streets and alley shall be let upon
competitive bids and shall be let
to the lowast and best bidder, who
shall entetr into a contract with
tjie City of Yale .Oklahoma, and
execute to the City of Yale, Okla-
homa, a good and sufflcieut bond
in the amount of fifty per cent, of
his bid conditioned for the full
and faithful performance of the
contract, and for the protection
of the city and all property own-
ers interested against any loss or
damage by reason of negligence
of the contractor or improper exe-
cution of the work or by the use
of inferior material, and shall, in
addition to said bond, execute to
the said City of Yale, Oklahoma, a
good and sufficient bond in the
sum of ten per cent of the con-
tract price of said improvements,
conditioned upon the maintenance
in good condition of said improve-
ments of said street for the period
of not less than five years from
the time of the completion of the
same.
The successful contractor shall
furnish also a good and sufficient
bond to the State of Oklahoma in
•the sum of not less than the total
sum of the contract prices of said
improvements, conditioned that
such contractor shall pay all in-
debtedness incurred for labor and
matetrial furnished in the con-
as provided by the statutes of the
State of Oklahoma.
Section 5—The City Cerk is
hereby instructed to advertise for
sealed proposals for furnishing
of the materials and parforming
the work necessary in making the
improvements provided herein.
The otice for the said proposals
shall statet the streets to be im-
proved, the kind of improvements
proposed, the bonds required to
be executetd by the contractor
and shall refer to the plans and
specifications, and shall designate
the time end place where the same
wwill be considered by the Mayor
and council of the City of Yale,
Oklahoma; and said notice shall
also recite that the Mayor and the
City Council of the City of Yale,
shall have the right to reject any
and all bids when such bids are
not in their judgment satisfac-
tory, and also a certified check on
a local bank in the amount of ap-
proximately ten per cent of the
amount of the bid shall accom-
pany each bid, which said check
shall be made payable to the City'
Clerk and shall become the prop-
erty of the City of Yale in the
event the successful bidder shall
fail to entetr into a contract and
furnish the bonds required within
ten days from the date of the
award thereof Said notice shall
be published in two weekly issues
of the Yale Democrat, a newspap-
er published and of general circu-
lation in both the City of Yale
and the County of Payne, State of
Oklahoma •
Section 6—That at the time and
place provided in said notice the
Mayor and City Council of the
City of Yale shall open and exam-
ine all bids received without un-
necessary delay, award the con-
tract to the lowest and best bid-
der; provided, however, that said
contract shall in no case exced the
estimate of cost submitted by the
said City Engineer with the plans
and specifications for said im-
provements, which were approved
March 15, 1920, and now on file
with the City Clerk of the City of
Yale, Oklahoma.
Section 7—This resolution shall
(be published for two successive
weeks in the Yale Democrat, a
newspaper of general circulation
in the said City of Yale, County
of Payne, Statet of Oklahoma, and
the owner or owners of any land
liable for assessment for the im-
provements provided for in this
resolution may file with the City
Clerk at his office in the City of
Yale, his or their protest in writ-
protest must be filed within fif-
teen days from the date of the
last publication of this resolution,
this, the 15th day of March, 1920.
