February 25th, 1901.
Hoard of county commissioners met In special
session as per call of county clerk. Present,
Harry Jones and P. H. Sullivan, commission
ers, and A. J. Hartenbower, county clerk.
In absence of chairman W. E. Mlnnich,
Harry Jones was elected chairman pro tern and
after organization was effected the following
business was transacted:
Order of district court relative to claims
against county for expense Incurred in cause
entitled. Oklahoma Territory vs. Louis Lee,
was considered. Order granted and complied
with ami warrants signed by A. J. Harten-
bower. county clerk, and Harry Jones, chair-
man pro tern’
The board authorized county clerk to furnish
expense of transportation to Frank Mason from
Perry. O. T. to Aelden, Iowa. A probable
county charge.
Th aboard accepted the resignation of .1. W.
I Hoover, township treasurer of Rook township,
| and appointed D. <’ Taylor to till the vacancy.
The board appointed A. F. Spurgeon town-
ship treasurer of Faredlse township to fill va-
cancy .and M F. Golden justice of the peace for
! Rock township.
The board appointed L F. Parmley township
I clerk of Pawnee township.
In the matter of the application of William J.
Payne to sell malt, spirituous nnd vinous liq-
uors upon lot 4, block 13, In the town of Cush-
ing. Payne county, O. T.:
Now on this 25ih day of February, 1901,
the above matter comes on to be heard before
the board of county commissioners at one
o clock t>. m. The applicant present in person
and by hi3 attorneys. A. T. Neill and Robert A.
Lowry. Remonstrators present In person and
by their attorne , P. P. Hillerman.
Thereupon it is agreed by and between the
attorneys for the applicant and attorney for
remonstrators that the evidence in the matter
of this hearing shall be taken in short-hand by
AnnaM. Maloney and afterwards transcribed,
served nnd tiled by tier with the county clerk of
said county as the evidence In said cause.
Thereupon the applicant deposits with the
said county clerk the sum of f 1.00 to cover cost
of taking testimony on the part of applicant
and the remonstrators announce that they will
make a deposit or file a bond to secure upon
taking of their testimony.
It is further agreed by and between the -ip-
plicant and remonstrators that the
persons as shown agreed to appear on the peti-
tion of said applicant are resident tax payers of
ward one in the said town of Cushing.
After an extended direct and cross examina-
tion of witnesses introduced by applicant, cause
was submitted to the board, the protestors rest-
ing their ease w ithout the introduction of w t-
nesses and wholly on evidence submitted by ap-
plicant.
In the matter of the application of Louis J
Jackson for a license to sell malt, snirltw'iis
and vinous liquors, also set for hearing at the
above named date, at lot 8, block 2, in the first
ward of the town of Cushing, Payne county, O.
Now. on the 25th day of February, 1901. the
above matter comes on to be heard before the
board of county commissioners at 1 o'clock n.
tm. The applicant present in person and by Ills
attorneys. A. T. Neill and Robert A. I.owrv. and
the remonstrators present in person and by
their attorney, 1*. P. Hillerman.
Thereupon it was agreed bv and between the
parties that the evidence produced and heard by
the hoard of countv commissioners in the mat-
ter of the hearing of the application of William
J. Payne can be taken and considered as the
evidence in the ease, and that the above appli-
cation can tie submitted to the board of county
commissioners.
Cause being submitted, the board ordered
that license to sell malt, spirituous and vinous
lienors be granted to the aforesaid applicants,
William J. Pavne and Louis J. Jackson, for
twelve months from date of Issuing same, when
law had been fully complied with regarding
bond and payment of amount of county license
into county treasury.
The hoard also decided that application for
liquor license to the aforesaid conforms to the
law, and that said application contains the
names of at least thirty resident tax payers of
said ward one of Cushing. O T., as verified by
witnesses of aforesaid applicants.
To all of which protestors except and through
their attorney. P. P. Hillerman. give notice of
appeal.
The board adjourned sine die.
