An Ordinance /ranting to The Oklaho-
ma Natural Gas Company, a corpo-
ration, its successors anJ assigns,
for a period of twenty-one years
from the taking effect of same, the
right to acquire. sell, furnish, and
supply, transport, transmit, and
distribute in and about and to and
from the City of Enid, in tie Ter-
ritory of Oklahoma, County of
Garfield, natural gas for the use oi'
the said City and the people there
of, for heat, light, fuel, power, an
other purpose*, upon the terrr.s
specified in said Ordinance.

cilmen of the City of Enid, County
of Garfield, Territory of Okltho;:.a
SECTION ONE.
That 'here is hereoy granted to Tbt.
Oklahoma Natural Gas Company, a
corporation, its successors and assigns,
for the period of twenty-one years

attend, as matters of importance to the

section two.
That in the construction of such nat-
ural gas system or any part thereof, or
any alteration, extention, or repair of
same, the said The Oklahoma Natural
Gas Company, a corporation, its suc-
cessors and assigns, shall so use the
streets, alleys, lanes, street crossings
and public grounds of said City, that no
excavation shall be left open or obstruc-
tion made, without being so guarded
as to prevent accident and injury, and
so that same shall not constitute a
public nuisance therein; and such exca-
vation shall be filled, the dirt filling
flooded with water and tamped, and
the ground made to conform to its for-
mer level and improvement and such
obstruction removed, all at the expenae
of the said grantee, as soon as the
progress of the work will permit; and
in case of failure or refusal of the
grantee to comply with the provisions
of this Section, the City may fill such
excavations and remove such obstruc-
tions and recover the cost thereof from
the person or persons making or caus-
ing the same, including the expense of
restoring the surface, in all respects,
to its condition prior to excavation or
obstruction.
Wherever practicable, said grantee
shall use the alleys of said City for the
laying of its pipes, mains, or conduits,
subject to the direction of the City
Engineer.
section three.
That the said The Oklahoma Natural
Gas Company, a corporation, its succes
sors and assigns, shall indemnify said
city, by giving a Bond in the sum of
| Five thousand dollars ($o,0 XI.0J), said
Bond to be approved by the City Coun-
j cil, and to be furnished and approved
before the commencement of the work,
against loss occasioned by reason of
any violation of this Ordinance, or by
lack of care and diligence in the prose-
cution of any part of the work herein
authorized; and shall reimburse said
City for all damages and costs, if any,
for which it becomes liable by reaaon
of the acts or conduct of the grantee
hereunder, the said Bond heretofore re-
ferred to, to run the entire period of
this franchise.
section four.
That the said The Oklahoma Natural
Gas Company, a corporation, its sue-j
cessors and assigns, is hereby limited in ,
its ehargee to a maximum of thirty-five
ef nts (35 cents) for each one thousand
(1,000) cubic feet of natural gas
furnished frr ernfiin.ption to «aid City
or the pteple thereof, to be ascertained
by approved meter measurement, said
meters to be furnished by the said
grantee, free of charge to the said
consnmers; provided, however, that
said grantee fkult have the right to
ckarge a minimum of fifty certs (80
cents) per rror.th for each meter con-
nected.
In the event any consumer shall fail
to pay his bi the 10th day of the
month succeeding the rendition of ser-
vice, the said grantee shall have the
right to charge sui h consumer er. addi-
tional ten cents (10 cents) for t;. Ji one
thousand (1,000) cubic feet of t'as fur-
nisheu, and to disconnect said consum-
er.
section five.
That the said The Oklahoma Natural
Gas Company, a corporation, its succes-
sors and assigns, shall have the bene-
fits and privileges of this Ordinance for
a period of six months from the taking
effect of same, but not longer, unless
within such time it shall begin work
looking to the establishment and instal-
lation of the gas system herein provid-
ed for, and thereafter, with all conve-
nient speed, shall continue such work
until completed, the said work to be
completed and the gas supplied to said
City within fifteen (IE) months from
the passage of this Ordinance.
section six. 1
That the said The Oklahoma Natural
Gas Company, a corporation, its suc-
cessors and assigns, will replace any
pavement that it removes in any of the
alleys or streets of said City, in laying
the necessary pipes and conduits for its
gas system, in as good condition
when it was removed, the cost of re-
placing same to be paid by the said
grantee of this Ordinance, without any
charge to the s&id City, said work to be
done under the supervision of the City
Engineer and subject to his approval.
section seven.
That the said The Oklahoma Natural
Gas Company, a corporation, its suc-
cessors and assigns, hereby agrees to
furnish City Hall, Library, and Fire
Departments in the City of Enid with a
sufficient supply of gas for lighting and
heating purposes, free of charge to
said City.
section eight.
That the violation of or failure to
comply with any of the conditions or
provisions of this Ordinance, on the
part of The Oklahoma Natural Gaa
Company, a corporation, its successors
and assigns, shall render this Ordinance
null and void.
section nine.
That the said The Oklahoma Natural
Gas Company, a corporation, its suc-
cessors and assigns, hereby agrees to
pay all costs of the publication of the
foregoing Ordinance.
section ten.
That this Ordinance shall take effect
and be in full force from and after its
passage, approval, and publication in
the Enid Wave on condition that
the said The Oklahoma Natural Gas
Company, a corporation, its successor!
and assigns, shall, within twenty (20)
days from such passage and approval,
file in writing, in the office of the City
Clerk of the City of Enid, its uncondi'
tional acceptance of the franchise here-
in granted and set out.
