Sec. 1. It shall be unlawful for any
horse, mule, ass, colt, sheep, goat,
swine, cow, steer, bull, calf or any other
animal to run at large within the cor-
porate limits of the village of Lexing-
ton, and any of said animals so found
running at large shall be dealt with as
herein aftei provided.
Sec. 2. The Marshal and all police-
man of the town and such other per
sons as the Marshal may in writing
designate and appoint, shall be and are
hereby authorized and empowered to
take up all n n als found running at
large within tlio town of Lexington,
contrary to the first section ol this or-
dinance, and confine them in such
pound, building, pen, or other place
as may be designated by the Marshal
and the Marshal shall provide suitable
and necessary sustenance forallani.

shall proceed to advertise the same for
sal by posting notices thereof in four
public places in tlio town' said notices

advertised shall not be redeemed and
the charges thereon paid by the owner
or owners thereof before the day of sale
then the Marshal shall proceed to sell
the same at public auction.
Sec. 4. The proceeds arising from Said
sale shall first be applied to the pay-
ment of all charges and expenses incur-
red in the keeping of said animal or
animals, and the residue, if any, shall
be paid into the town treasury, and the
Marshal shall take from the treasurer
duplicate receipts for the amount so
paid in, one of which he shall file with
the town clerk, together with a state-
ment giving a complete description of
said animal, the day impounded, the
day of sale, the amount realized from
said sale and the expenses and Costs
incured in the keeping of said animal.
Sec. 5. If the owner of any animal shall
apply to ami pay the Marshal the costs,
charged and expenses incured under
this ordinance at any time befoie the
sale of such animal, the Marshal shall !
release such animal. If the owner of j
any animal "hall apply to the Marshal >
after such animal has been sold, and
prove the ownership thereof to the sat-
isfaction of the Marshal, before pay-
ment into the town treasury, the Mar-
shal shall pay the balance due from the
sale of such animal to the applicant,
taking his receipt in duplicate, one of
which receipts he 11 file with the
town clerk. But if the owner of such
animal shall apply to the Marshal af-
ter paymeut into the town treasury and
prove the ownership thereof to the sat-
isfaction of the Marshal, then the Mar-
shal shall certify the fact to the presi-
dent of the Board of Trustees, stating
the amount deposited in the town

thereupon a warrant sahll be sworn up-
on the treasurer in favor of the claimant
for the amount so certified by the Mar-
shal, and the clerk shall file and pre-
