Kansas People Have Another
Lease on Their Gas
Situation
Cofleyville, Kan., Dec, 17. The
Kansas Gas Protective Association lias
scored aDothir victory and the i nr
point that has been the griatest p e-
limiuary obstacle to surmount has
been removrd. The federal court by
Judge Pullock, has granted a tempor-
ary restraining order and the argu-
ments in the case will be heard Jan-
uary 7af er the meeting of the legis-
lature.
Tbe Gas Protective Association got
the matter into the federal court in
the following m-nner: C. H. Rockwell
owns a forty acre strip of land four
miles south of Independence and along
s de tne highway where the Kan-as
Natural Gas Company has strung pip-*
for the Joplin line. Mr. Rockwell
being & non-resident of the state
brought sur. in the federal court to eo
join the Kansas Natural Gas tompanv
from laying a pipe alongside his pre-
mises. The su t is brought by the
Kansas Gas P otective Aseoeia'ion
through Mr. Rockwell. J. H. Dana of
this city, attorney for Rockwell, filed
the pet’tion.
It was necessary that the non-resi-
dent file the suit in order to get the
matter into the federal court. Which
ever way Judge Poliock decides will
make lit'le difference with the real
outcome in the gss question The
paramount issue now is the legislative
enactments. The pipe line 'canDOt be
completed before tbe 7th of Jauuary,
but during th»t time the s.nators i nd
representatives must be consulted
