If there are prisoners held in the
state penitentiary contrary to law
their release must he accomplish-
ed through the court, is the hold-
ing of Attorney General West in
a decision to Clyde Reed, warden
of the Granite state reformatory.
RCfcd wrwote the attorney gen-
eral that four or live prisoners
were held upon sentences of one
year for the sale of liquor to
minors, the conviction being un-
der the Ross aet of the second
legislature. The criminal court
of appeals recently held the law
to he in conflict with the connsti-
tution, so far as the minimum sen-
tence for liquor law violations
were concerned, and dircted the
warden of the McAlester peniten-
tiary to take before the district
court of that county all prisoners
so held, for release by writ of
habeas corpus. The attorney
general suggests that Warden
Reed may do the same at Granite
since penal prisoners cannot be
released upon the personal deci-
sion of the warden.
