ION IN SCHOOL
CASES.
Settles Much Controverted Question
Regarding the Secarian
Schools.
Washington, April 5.—In a decision
handed down by Justice Ashley M.
Gould of the supreme court of the
District of Columbia it is declared
that the treaty funds of Indians can-
not be need for the support of sectar-
ian schools. The court will Issue a
decree enjoining the commissioner of
Indian affairs from paying to the bu-
reau of Catholic Indian missions the
sum of |27,000 which had been agreed
upon between the commissioner and
the Catholic bureau for the care, main-
tenance and education of 250 Indian
pupils at the St. Francis mission
school in the Red Bud agency in S.
Dakota.
Justice Gould decides, however, that
the commissioner may apply trust
funds toward the education of Indian
children In sectarian school.
This is the first legal decision that
has ever been handed down in this
much controverted question and is far
reaching in its importance. It will
affect not only the Indian bureau, but
the schools of any denomination or
religious belief where Indian children
are given education.

"Frenchy," who committed suicide in
Shawnee, was buried in Fairview cem-
etery this afternoon by the county.
No trace of his relatives could be se-
cured.

ed an interview with Hon. Cassius M
Cade, national republican committee-
man, that misquoted him by telling

as stated by Mr. Cade are that the
constitutional convention has not
merely gerrymandered the county
boundary lines, but has disfranchised
many republicans and framed things
in a fashion that can't help hut be

counties like Tillman, with only 8,000
people, the same representation is
given as a republican county like
almost impossible for any party to
overcome such unfair odds. By dis-
franchising so many republican voters

nearly 70,000 people were robbed of

will carry Oklahoma. No governor

Oklahoma City, Okla., April 5—That

dian of Etta Smalley, who Is at pres-
ent living at the home of Noah B.
Wickam of 1639 West Twenty-fourth
street, and that he is entitled to the
custody of the child, as her mother is
Incompetent to care for her, are the
alleged facts that James H. Smalley
will attempt to prove to the satisfac-
tion of Judge Harper In probate court
Monday morning.
In the event that he is able to
prove that he is yet the parent and
guardian of his child, It Is probable
that Ihe court will give her into his
custody.
The child became separated from
her parents, according to Smalley's
petition at the time of their separa-
tion. At first she was given into the
custody of her mother. She was then
placed in an orphans' home at Enid.
Thence she came from Enid to Okla-
homa City with the Wickam family.
Now the father desires to regain pos-
session of his daughter.
The case was to have been heard
in probate court yesterday, but was
set over until Monday by agreement.
