PfElifninary Survey
Road from Muwkonee to Shawnee
May Come Southwest.
Shawnee. O- T. Dec. 13. The
preliminary survey commonly call
ed the "horseback survey" in rail
road parlance of the new road from
Muskogee via. Henryetta I. T.to
Shawnee has been completed and
arrangements for the final survey
preparatory to letting the contract
for building the line to 'grade are
now being made.
The horseback survey was com
pleted a few days since as far as
Shawnee and gentlemen are now
in the city preparing for the final
work. The road will be built first
to Shawnee and later on to the
southwest from this city. The
definite location of the southwest-
ern terminus cannot be learned
except that it will probably be
Wichita FaMs Tex.
The new line is the Missouri Ok-
lahoma & Gulf which is the Mus-
kogee Union under the name of the
company headed by Mr. Kenefick
which has bought the short line.
Tr.e Muskogee Union is now only
a few miles long and connects
Muskogee with the Missouri Pa-
cific which is good ground for the
report that the M. O. & G. belongs
to the Missouri Pacific.

VINDICATION
For Judge Payne Investigation
Was Held Before Judge Dick-
erson Last Night.
THE CHARGES FALL FLAT
Best Citizens Testify to the High
Character of Payne.
An investigation oi charges pre-
fered against E. M. Payne U. S.
commissioner. was conducted before
Judge Dickerson last night. It
will be a suprise to most people to
know that charges of any kind
were ever made against Judge
Payne A lit te history is there-
fore in order.
Sometime last summer W. L.
Sawyer addressed a communication
to the Attorney General in Wash-
ington making charges against
Judge Payne and asking for an in-
vestigation. The Attorney Gen-
eral referred the matter to Judge
Townsend who notified Judge
Payne and arranged for an investi-
gation at the present term of court.
The charges against Judge Payne
were numerous the first one being
that Judge Payne was a "hard-
drinking man." In addition to
this it was charged that he had
been drunk on certain occasions
that he had permuted liquor to be
introduced into the territory and
various other charges of a similar
character.
A large number of witnesses
were subpoened. Attorneys W. I.
Gilbert and R. D. Welborne volun
teered their services and conducted
the investigation in behalf of Judge
Payne and Attorney John A. Mc-
Clure appeared for the complainant
W. L. Sawyer. A vast amount of
testimony wa9 introduced but there
was little in it worthy of repetition.
The preponderance of testimony
failed to substauliate a single
charge.
Nearly every lawyer in town to
gether with bankers and other good
citizens were called on and tes
tified to the higheharacter of Judge
Payne. Not only were the charges
against him refuted init the vast
amount of testimony brougiii out
auot'UAd a sirikniir testimonial to
to the worth of an upright ofiicial
and an abundant vindication.
Judge Ihckerson will lender his
findings in the case -.ojudg To.n-
siinl. Whatever the result may
be Judge Payne is vindicated.
