No Refund of Taxes.
In the tax cases appealed from Mm
Bonrd of County Commissioners to the
District court this wpek it wns decided :
1hai thu Bimrdol County Oomlnls-
ioncrsmio not authorized by law to
refund or order tho refund of taxes
paid Into tho county treasury even
though the assessment was erroneous
or tho property nsseesed not taxable
but that prior to payment the board
is authorized to issue certificate of
error in cases whore property was not
assessable or had been nsserj&cd more
than onco for tho taxes of tho same
year. Itwasalso held that the officers
wore authorized to correct erroneous
descriptions of land on the tax rolls
after payment or before to Conform to
tho facts In any particular ca3e. These
decisions nro of considerable impor-
tance to tho taxpayers of tho county
in as much as tho tax ferrltt has dis-
covered a largo number of cases where
parties have been assessed erroneously
and have paid their taxes on such er-
roneous descriptions.
