AN ACT
Dividing Garvin County, Oklahoma, into three County Court Districts; designa
ting Stratford and Lindsay as additional County Court towns; providing
the class of cases to be tried in each County Court District; procedure
thereof; repealing House Bill No. 654 of the first legislature of the state
of Oklahoma, and declaring an emergency

Be It Enacted By the People of the
State of Oklahoma:
Section 1. For the- purpose of this
Act, the County of Garvin, State of
Oklahoma, is hereby divided into three
(3) districts, denominated Pauls Val-
ley County Court District, Stratford
County Court District, and Lindsay
County Court District.
Sec. 2. The Pauls Valley County
Court District shall consist of all that
part of Garvin County lying between
the Stratford County Court District
and the Lindsay County Cour' Dis-
trict, as hereinafter described. The
Stratford County Court District shall
donslBt of all that part of Garvin
County beginning at the southeast cor-
ner of said county, and running thence
west along the south boundary line of
said county to range line between
range 2 and 3 east; thence north on
said range line between range 2 and
3 east to a point where said range line
intersects the township line between
townships 2 and 3 north; thence west
along the township line to a point on
said line between section 34 and 33, _
in township 3 north, range 2 east;
thence directly north to the north
boundary line of said Garvin county;
thence east along said north boundary
line of said county to the northeast
corner of said county; thence soutlii
aiong the east boundary line of said
county to the place of beginning. ,
The Lindsay County Court District
shall consist of all that part of Garvin
County beginning at the northwest cor-
ner of said county and running thence
oast along the north boundary line of
said county a distance of twelve miles
to a point where the range line be-
tween range 2 and 3 west crosses the
township line between township 4 and
5 north; thence south along the range
line between range 2 and 3 west to a
point on said line between sections 13
and 24 in township 2 north, range 3
west; tlience west to the west bound-
ary line of said county; thence north]
three miles with the west boundary
tine of said county; thence west 6
miles; thence north 12 miles with the
west boundary line of said county to
the place cf beginning.
Sec. 3. Upon the taking effect of
this Act, it shall be the duty of the
County Judge of said County of Gar-
vin. to appoint, subject to the approval
of the Board of County Commissioners
of said county, for the Stratford County
Court District a Deputy Clerk, and a
Deputy Clerk for the Lindsay County
Court District, each of said Deputy
Clerks of the respective county court
districts shall keep his office at the
county court town of said district for
which he is appointed, and each of said
deputy clerks shall have the qualifi-
cations and perform such duties as are
now, or may be hereafter, required of
the clerks of the county courts of this
State. Tlie compensation of said dep-
uty county clerks shall be fixed by the
county commissioners; provided, that
said county commissioners shall in no j
event fix the salaries of said deputy I
clerks in excess of Six Hundred
($600.00) Dollars per annum. The sal-
aries of said deputy clerks shall be
paid out of the funds of said county
in the same manner as the clerk of the
county court of said county is now
paid, as provided by law.
It shall be the duty of each of said
deputy clerks to keep all files, books,
papers and records at his office which
pertains to all civil and criminal ac-
tions and proceedings instituted in or
removed to said county court district, j
Sec. 4. All civil and criminal ac- j
tions brought in said county court in i
which there is but one defendant shall
be commenced in that county court dis-
trict in which said defendant may then
reside or have his place of domicile.
Where there are two or more defend-
ants the action may be brought in that
district in which either or any of said
defendants may reside or have his
place of domicile. Wbefe none of said
defendants reside in the county the
action may be brought in either of said
county court districts.
Sec. 5. All probate proceedings in
said county court shall be commenced
in that district where the decendant
may have died, or in which any real
estate to be administered may be lo-
cated, or in which minors reside or
have an estate, having regard to the
character of the respective proceed-
ings.
Sec. 6. All appeals from judgments
of Justices of the Peace of said county
of Garvin, which shall be taken to the
county court, shall be filed in the coun-
ty court district in which the de-
fendant or some of the defendants may
reside or have their domicile; pro
vided, that all criminal cases in said
county court in which the defendant
is confined at the time in the county
jail shall be tried at the county seat
of said county.
Sec. 7. Whenever it shall appear to
the County Judge, upon proper affida-
vits, or other showing, and upon proof
of at least five days' notice to the attor-
ney for the adverse party, that an ac-
tion or proceeding r as been erroneous-
ly commenced in the wrong county
court district, it shall be the duty of
said County Judge, by order, to traus-
sr said action or proceeding to the
proper county court district, and the
clerk or deputy clerk shall thereupon
transmit all papers, files and record*
in connection therewith to such proper
district, where said action or proceed-
ing shall be proceeded with as if the
same had been originally instituted
therein. Said action or proceeding
shall not be dismissed because of said
erroneous bringing of the same; but
before the parties so instituting said
action or proceeding shall be allowed
to further prosecute the same, he shall !
within ten days from the said transfer
pay all costs in the court first enter-
taining said action or proceeding; and
if said costs shall not he paid it shall
be the duty of the County Judge to dis-
miss said action or proceeding in said
county court district to which transfer
shall have been made. Any cash de-
posit or bond to secure costs of the
institution of said action or proceed-
ing shall be transferred with other
papers as aforesaid.
Sec. 8. The place of holding terms
of the county court for the Stratford
County Court district shall be in the
town of Stratford; and the place of
holding terms of the county court of
the Lindsay County Oourt district shall
be in the town of Lindsay; and the
terms of said county court shall be
held in said towns in said districts us
is by law provided. Provided, that be-
fore any session of the county court
shall be held in either of said districts,
a proper and comfortable deputy
clerk's office and court room shall be
furnished by each district respectively,
and shall be furnished and supplied
with the proper furniture and fixtures
without cost to the said county of Gar-
vin, and said county shall not be liable
in any way for the rents of said rooms.

It is said that Dr. Burns and
the divorced Mrs. Mays wore
married in Louisiana about,

Adultery Charged

Dr. Burns is also under indict-
ment for shooting L. H, Mays,
the former husband of the
woman arrested.
