District Attorney Penny lired these
at the prisoner, his voice rising with
each succeeding question, hut O.ol-
go-z stubbornly refused to answer.
The district attorney respectfully sug-
gested that counsel be asu'gr.ed to de-
fend the [iris iner and ascertain what
he had better do as to his plea to the
indictment before arraignment. Judge
F.mery then asked the prisoner before
the bar if he had counsel, hut there
was no answer, despite the fact that the
peace officers told him the jndje was
speaking and that lie must answer.
The court then said : "Czolgosz, you
having appeared for arraignment iu
the court, without counsel, the law
] makes it the duly of the court to as-
] sign counsel. The bar association of
our county has considered the matter
and suggested the names of certain
gentlemen of high character for such
assignment. The court has seriously
considered the question, and after
much consideration hns concluded to
follow the suggestion made by the as-
socia tion . l'he court therefore assigns
Loraine L. r.e*is and Robert C. Titus
as your counsel."
Czolgosz was handcuffed to the de-
tectives, who started out of the court

Buffalo, Kept. 18.—Leon K. Czolgosz,

bj the county court grand jury for the
erime of murder in the first degtee in
fatally shooting President MiKinley
st the Temple of Music in the Pan-
American exposition grounds at 4:15
(.'clock on the afternoon of September
6. When arraigned before Judge Kd-
ward K. Kmery in the county court
the prisoner stubbornly refused to
anawer questions repeatedly asked of
him by District Attorney 1'enney as
to whether he had counsel or wanted
counsel. The district attorney then
a Uggested that, inasmuch as the defend-
ant refused to answer, counsel should
be assigned.
Judge Kmery assigned Lorain I..
Lewis and Robert Titus, former su-
preme court justiccsof thiscity, whose
names had been suggested by the Krie
county bar association.
Czolgosz pri batily w ill be arraigned
again tomorrow morning to pl*ad to
the indictment.
District Attorney Penney presented
the evidence in the murder case to the
grand jury. Aside from the surgeons
and physicians in the case no witnesses
were sworn other than those w ho were
in the Temple of Music and witnessed

prisoner, but it is alleged that he was
locked up in the temporary jail at tne

have been kept while the jail has been
undergoing repairs. After the indict
ment was reported the prisoner was
driven from the penitentiary, a mile
from the city hall, to the jail across
the street from the hall. Czolgosz was
then taken under a strong guard from
the jail through the tunnel under Del-
egare avenue to the basement of the
city hall and up the stairs to the court
room on the second tloor.
The prisoner was shackled to a de-
tective and aiiot her detective held his

ber of patrolmen behind. When the
prisoner wai taken before the bench
the crowd in the court room surged

on his face gave linn an unkempt ap-
pearance. Appnrrently he feigned in-
sanity, not stupidity, and his glance
roamed about, but his eyes werd al-
ways downcajft. Not once did he look
the county prosecutor or the Judge in
the face.
''Czolgosz, have you got a lawyer?
Do you wish a law yer'.' You have been
indicted for murder in the first degree.
Do you want a lawyer to defend you?
That famous comedy, "Finnigan,s
Ball,'' which will be seen at the Opera
House tonight, is really a phenomenal
farce comedy. Murphy and Moran's
comedians gave the first performance
of this piece in November, 1892, and
with the exception of the usual sum-
mer respite, it has been before the
public continuously ever since; for
three seasons two companies presented
it in different parts of the country at
the smiie time. This is itseighth year,
and since it first saw the foot fights it
lias entertained over three million of
people, who have paid at the box of-
fice window over one million dollars
for their entertainment. It is doubt-
ful if any other farde comedy can show-
so remarkable a record. One re asm
that it has continued to please year
after year is because it shares, with all
other pieces of this class, that elastic-
ity of character which allows it to be
changed and brightened from year to
jeir. During the past summer it has
been completely re-written, retaining
nothing whatever of the old story ex-
0 pt the title. The dialogue, plot and
situations are all new this season, and
make of it virtually a new play. Inas-
much as the piece is making this year
a more emphatic hit than ever before,
it conclusively proves that the latest
version is the best. The company is
the best that has ever been seen iu the
piece. This season. 11s in pust years,
the music is the latest and most up-to-
date of all the popular songs, and the
singing is one of the most entertaining
features of the psrformancc.
