The jury in the case of John Lane,
charged with assault to kill Walter
Phillips, on trial in district court yes-
terday, brought in a verdict of acquic-1
tal after being out about an hour. Mr. j
Lane took the stand in his own de-
fense and told a very straight story,
and one that evidently impressed the |
jury. It was to the effect that Walter 1
Phillips and his brother-in-law, Ar-1
thur Holstein, came to the cotton i
patch where Lane was, on the day of j
the affray last November, south of
Mardock, and picked a quarrel with i
him, and that he felt they were going
to "double-team" on him and do him J
great bodily harm, so he beat them to
I it by shooting Phillips. He said he did I
! not aim to kill, but only to disable;
and it was also shown that he (Lane) |
j is a deadshot with a revolver and j
! could have killed had he wanted to.}
He testified he had the revolver with !
| him to shoot squirrels, which sounded j
| somewhat fishy until it developed
j that he hardly ever misses a squirrel
