Sues the City and 0. J. Fleming for
an Injunction.
CLAIMS A BREACH OF CONTRACT.
Mr. Ft. J. Edwards of Oklahoma
City, who speculates in the purchase
and sale of bonds entered a petition
in the District Court Saturday last,
praying for an injunction against the
city authorities for delivering the
water and sewer bonds to the amount
of $40,000 to"Mr. O. J. Fleming.
Edwards claims that he was the
purchaser of the bonds through O. .!•
Fleming who simply acted as an agent
for him.
Mr. Fleming informed a Wave re-
porter this afternoon that he acted
for himself in bidding for the bonds
and did not name Mr. Edwards or any
other person in the deal. It is true,
said he, that I first intended to deal
with Edwards in the desposition of
the bonds and agreed to let him have
them. In the mean time 1 informed
Mayor Faubion and the city council
to consider the bonds sold and to go
right along making arrangements
and buying material for the preposed
sewer and water improvements and
that I would make advances of cash
in advance of the delivering of the
bonds. I wrote Mr. Edwards fre-
quently in regard to the deal, as to
whether he would be prepaired for
the payment or ' he bonds on deliver-
ey. He nev r gave me any positive
assurance that he would take the
bonds; actually nothing that a good
business man could depend on posi
tively.
To be safe in the transaction I was
compelled to deal with other parties
who assumed the obligation without
any "ifs or ands" about it.
I can't understand why he makes
the city a party to his injunction suit
No action of the kind he has brought
will lie against me as there was no
expressed contract between he and I,
but if he has any grievance from
which he can recover it is certainly
against me, not the city of Enid or
oilicers thereof. If he had ever
agreed positively to take the bonds,
within a reasonable time. I would
have been glad to have dealt with
him.''
It looks very much to the Wave
as if Col. Edwards has prayed for an
injunction to patch up the dilitary
movements of himself and secure a
set of bonds t hat are no>v beyond his
reach. The city government has
nothing to do with the matter. They
contracted with Mr. Fleming and it
is none of their business what Mr.
F'eming does with the bonds after
they are paid for and turned over.
