Before the probate court at Oklahoma
City, Saturday, the ca-e of Thomas Kol -1
ertson vf. T. M. and D ('. Richardson
was tried. This was a case to recover j
deposited with the old First State '
bank, (fcvned by the K oourdswn'i?, and
lost in the crash of the consolidated
banks, or the First State bank of Perry
Mr. Uobertfcon is a farmer, living live
miles southeast of the city, and the lots
of this money very seriously crippled
him. as it did many others. He claims
to have Known nothing of the consolida-
tion of the two bank:* until after the
failure.
The defense could not swear that they
sent this particular depositor notice of
the consolidation, nor that he received a
copy of the Enterprise containing no-
tice of the withdrawal of the Richard-
sons. To. timony of the defense was to
the effect that he received notice
with the rest, and, being a subscriber of
the Enterprise, he was fully notitied,
according to the epirit of the law.
After a protracted light, in which At
torneys Tillery and Snyder contested
every inch of the ground, the cast was

room. The first ballot was unanimous
in favor of the Kichardsona. Naturally
